1. Acceptance
By accessing or using evofiusa.com (the "Site"), you agree to these Terms of Use. If you do not agree, do not use the Site. "EVO Financial," "we," "us" and "our" refer to EVO Financial.
2. Our services
EVO Financial is a commercial funding broker. We help businesses find and compare funding from independent third-party funding partners. We are not a lender or a direct funder, and we do not make credit decisions. Funding offered through the Site is for business purposes only and is not available for personal, family or household use.
3. No offer or commitment
Information on the Site, including the funding estimator and calculator, is general and for illustration only. Nothing on the Site is an offer, approval, quote or commitment to fund. Any funding is provided by a funding partner, subject to its own review and to a written agreement between you and that partner.
4. Information you provide
When you submit an application, partner application or message, you represent that you are authorized to act for the business named, and that the information and documents you provide are true, complete and yours to share. You authorize EVO Financial and its funding partners to verify that information, to obtain business and personal credit reports, and to share your application with funding partners to evaluate your request.
5. Acceptable use
You agree not to use the Site for any unlawful purpose, to submit false or another person's information, to interfere with the Site's operation or security, or to copy or scrape its content by automated means.
6. Intellectual property
The Site and its content, including the EVO Financial name and logo, belong to EVO Financial and may not be used without our written permission.
7. Third-party links
The Site may link to websites we do not control. We are not responsible for their content or practices.
8. Disclaimers
The Site is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, EVO Financial is not liable for any indirect, incidental or consequential damages arising from your use of the Site, or for the decisions, terms or conduct of any funding partner.
10. Governing law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules.
11. Changes
We may update these Terms at any time. The effective date above shows when they last changed. Continued use of the Site means you accept the updated Terms.
